Sotomayor not the right candidate

Judge Sonia Sotomayor should not be confirmed to the Supreme Court.

The controversy swirling about her is based on remarks said to be racist. I don’t think she meant anything racist but was just making idle chitchat. However, there is a solemnity about a judge’s position and they shouldn’t be making careless remarks.

Sotomayor should be turned down because she has demonstrated that she either doesn’t understand our Constitution or, worse yet, does but wants to circumvent it. If I read her correctly, she maintains that the states have the right to change the Second Amendment as they see fit, disregarding the constitutional wording.

The last paragraph says “the right of the people to bear arms shall not be infringed.” Nothing could be more direct, succinct and devoid of interpretation as those words. The Tenth Amendment clearly differentiates between people and the states so there is no confusion who the “people” are. The part referring to state militias takes a longer explanation but doesn’t alter the meaning of the amendment.

The Second Amendment is perhaps the most important of all since, without it, the other amendments have no teeth.  President Barack Obama should look for another candidate for the Supreme Court.

And as Mr. Graham should know, but perhaps doesn’t, the citizenry were granted the right to keep and bear arms as a counterbalance to tyrannical government.

And, as Mr. Dixon well knows, and chooses not to cite, because it undermines his argument, the first line in the Second Amendment reads:

“A well regulated Militia, being necessary to the security of a free State ...“

What part of “well regulated” is so hard to understand?
