Man to serve 4 months for crash

STAUNTON — A judge sentenced a Staunton man to four months in prison Thursday for a May 2008 crash on Route 340 that killed a 40-year-old mother of three.

Sentencing guidelines recommended a sentence of at least 10 months in prison for the involuntary DUI manslaughter charge on which a jury convicted Jeremy Rasnake in February.

“That [four-month] sentence, in the Commonwealth’s opinion, is way out of line,” Assistant Commonwealth’s Attorney Angela Landes argued Thursday.

Rasnake, 21, was twice convicted of reckless driving as a juvenile.

But Judge Victor V. Ludwig upheld the jury’s decision. Rasnake also had his driver’s license suspended indefinitely — after three years he can apply for a restricted license.

“I beg for your forgiveness and I’m still trying to forgive myself,” he said during sentencing Thursday.

Rasnake was driving a blue 1988 Ford Bronco north on Route 340 between Old White Hill Road and Kill Deer Lane on May 23 when, according to testimony, he fell asleep at the wheel, drifted across the center line and collided head-on with a silver 1994 Ford Thunderbird driven by Cheryl Lynn Sheaves, of Grottoes.

Sheaves died the next day at the University of Virginia Medical Center in Charlottesville.

Rasnake had faced a charge of aggravated involuntary DUI manslaughter, which could have meant a maximum of 20 years in prison. At issue in trial was the role of alcohol in the accident. The jury deliberated just over an hour before finding Rasnake guilty of the reduced charge of involuntary DUI manslaughter.

Defense attorney David O’Donnell said Rasnake was “clearly remorseful.”

You know what, this is ridiculous!!! I mean is that all this woman’s life is worth???? This guy should get more than a slap on the hand!! I don’t understand it!!!! I’m at a loss of word’s !!

I read a story once where a drunk driver had to pay the victims family $1 a week for a number of years. It seems like a small amount, but it forces the driver to have to think about what he did every week when he writes the check. This would be a good practice for all who kill innocent people while driving drunk.

This is terrible - I can only imagine who the family of the victim must feel.  What was this judge/jury thinking?  Either they must know an awful lot more than the paper has revealed, or this young man is a most skilled con artist.  My thoughts and sympathy are with Mrs. Sheave’s family as they suffer yet another trauma.

yes it is ashame, 4 months . 2 kids lost there mother and he gets 4 months. may god be with the victim family

4 months is shameful! Why not just slap him on the wrist, make him promise never to do it again then pour him a cold one!! My neices and nephew lost their mother for God’s sake to a young man who had/has no respect for himself or others.Yes he will have to live with what he has done and so he should!I hope he wakes every morning with her name on the tip of his tongue,the image of her with her 3 young children in his mind!What kind of message are we sending to other offenders not yet caught? Oh, I know..make sure you get caught in Augusta County, they treat you right! I am ashamed tonight to even admit to anyone I live in Augusta County
